I. Overview

These Terms and Conditions (“Agreement”) govern your access to and use of LucrTrade’s website, Discord community server, TradingView indicators, LucrJournal tool, educational content, and all related services (collectively, the “Platform”), operated by LucrTrade Limited, a company incorporated in Hong Kong (“LucrTrade,” “we,” “us,” or “our”).

By accessing or using any part of the Platform — including browsing our website, joining our Discord server, accessing any paid or free content, or downloading any tools — you confirm that you:

Are at least 18 years of age (or the legal age of majority in your jurisdiction, if higher);
Have the legal capacity to enter into a binding agreement;
Have read, understood, and agree to be bound by this Agreement in full.

If you do not agree to these Terms, you must stop using the Platform immediately.

II. Services Provided

LucrTrade offers the following services to its members:

Community Access — A private trading community via Discord featuring real-time trade sharing, market analysis, and member discussions.
TradingView Indicators — Professional-grade indicators (including EMA Suite, OHLC, Trading Sessions, FVG Suite, and others) published on TradingView and accessible to members.
LucrJournal — A local-first, Obsidian-based trading journal tool provided for personal use.
Educational Resources — A structured learning library covering trading fundamentals, advanced techniques, and order flow analysis.
Market Intelligence — Real-time news feeds, economic data alerts, and scheduled market analysis reports.

The availability, features, and scope of each service may change at any time at LucrTrade’s sole discretion.

III. No Financial Advice — Educational Use Only

All content, tools, indicators, market analysis, trade sharing, news, commentary, and educational materials provided on the Platform are for informational and educational purposes only.

Nothing on the Platform constitutes:

Financial advice, investment advice, or securities advice of any kind;
A recommendation, solicitation, or offer to buy, sell, or hold any financial instrument;
Tax, legal, or accounting advice.

LucrTrade Limited is not a registered investment adviser, licensed broker-dealer, signal provider, or financial institution of any kind. Any market analysis, trade ideas, or commentary shared by LucrTrade or its community members represent personal opinions only and do not constitute professional financial guidance.

You remain solely and entirely responsible for all of your investment and trading decisions and their outcomes.

IV. Market Commentary & Ticker Mention Disclaimer

In the course of providing educational content, market analysis, live sessions, community discussions, or any other form of content on the Platform, LucrTrade or its team members may reference specific companies, financial instruments, securities, cryptocurrencies, or ticker symbols by name.

Any such references are made strictly for illustrative and educational purposes only — for example, to demonstrate a technical concept, explain a chart pattern, or discuss a market scenario using a real-world example.

Such references do not constitute:

A recommendation to buy, sell, or hold the mentioned instrument;
An endorsement, sponsorship, or affiliation with the referenced company or security;
A signal, alert, or trade call of any kind.

LucrTrade and its team members may or may not hold positions in any mentioned instrument at any time. Any positions held are personal and do not represent advice or a recommendation to others. You are solely responsible for your own investment decisions. Do not trade any instrument solely because it was mentioned on the Platform.

V. Risk Disclosure

Trading financial instruments — including stocks, futures, forex, cryptocurrencies, CFDs, perpetual contracts, and options — involves substantial risk of loss. You should carefully consider whether trading is appropriate for you given your financial situation, investment experience, and risk tolerance.

Key risks include, but are not limited to:

You may lose your entire invested capital or more, particularly when using leverage or margin trading;
Past performance is not indicative of future results;
Hypothetical or simulated performance results do not reflect actual trading outcomes;
No indicator, tool, analysis, or educational content can guarantee profitable trading outcomes;
Market conditions can change rapidly and unpredictably.

Only trade with funds you can afford to lose entirely. Do not trade with money allocated for essential living expenses, retirement savings, education funds, or debt repayment.

By using the Platform, you acknowledge these risks and accept full personal responsibility for all your trading activities and financial outcomes.

VI. Eligibility

To access and use the Platform, you represent and warrant that you:

Are at least 18 years of age, or the applicable legal age of majority in your jurisdiction;
Are not barred from accessing trading-related content under any applicable law or regulation;
Are accessing the Platform for personal, non-commercial purposes only;
Will comply with all laws and regulations applicable to your use of the Platform in your jurisdiction.

LucrTrade does not verify whether its content is lawful or appropriate in every user’s jurisdiction. Users outside Hong Kong access the Platform entirely at their own risk and are solely responsible for ensuring compliance with their local laws.

VII. Membership & Subscriptions

LucrTrade offers both free and paid membership tiers. Paid memberships (“Premium Membership”) grant access to exclusive content, indicators, community channels, and other features as described on the Platform at the time of purchase.

Membership Rules

By subscribing to a Premium Membership, you agree to:

No sharing: Not share your login credentials, invitation links, access codes, or any membership benefits with any third party.
No redistribution: Not copy, screenshot, record, repost, republish, or otherwise distribute any paid or exclusive Platform content outside the Platform without prior written permission from LucrTrade.
No solicitation: Not solicit other members for commercial purposes, promote external products or services, or send unsolicited messages, spam, or bulk communications within the community.
No impersonation: Not impersonate LucrTrade, its team members, moderators, or other community members.
Respectful conduct: Treat all members with courtesy and respect at all times. Harassment, hate speech, discrimination, bullying, threats, or abusive behavior of any kind will result in immediate account termination without refund.
Lawful use only: Not use the Platform or its content for any unlawful purpose.

LucrTrade reserves the right to suspend or permanently terminate any membership account, with or without prior notice, for violation of these Membership Rules or at its sole discretion.

VIII. Refund Policy — All Sales Final

All purchases made through the Platform are final and non-refundable.

Because LucrTrade provides immediate digital access to proprietary educational content, trading tools, indicators, and community resources upon completion of purchase, we do not offer refunds, credits, exchanges, or returns for any reason whatsoever, including but not limited to:

Change of mind or circumstances;
Dissatisfaction with any content, tool, or service;
Personal trading performance, results, or financial losses;
Failure to use or access the Platform after purchase;
Finding the content too advanced, too basic, or otherwise unsuitable;
Technical issues on the user’s end (device, internet, browser, third-party platform);
Any changes to Platform features, content, or service scope.

By completing your purchase, you explicitly acknowledge that you are purchasing immediate access to digital content, that you waive any right to a refund, and that all sales are final.

Subscription Auto-Renewal: Unless you cancel before the end of your current billing period, subscriptions automatically renew at the then-current price. Upon cancellation, you will retain access through the end of your paid period. No pro-rata or partial refunds are issued for unused subscription time.

Chargebacks & Payment Disputes: Initiating a chargeback, payment dispute, or reversal with your card issuer or payment provider for a valid charge processed by LucrTrade constitutes a material breach of this Agreement. This may result in immediate permanent account termination and potential legal action to recover the disputed amount plus associated costs.

Exceptional Refund Processing Fees: In the rare event that LucrTrade, entirely at its sole discretion, agrees to issue a refund as a goodwill exception, the customer shall bear all payment processing fees incurred in connection with both the original transaction and the refund transaction, including any fees charged by payment platforms such as Stripe, PayPal, or any other payment processor. The refundable amount will be the original purchase price less all such applicable processing fees.

IX. Prohibited Conduct

By using the Platform, you agree not to:

Copy, distribute, sell, license, or share any Platform content outside the Platform without LucrTrade’s prior written permission;
Reverse-engineer, decompile, scrape, or attempt to extract any content, source code, data, or intellectual property from the Platform;
Use automated bots, scrapers, crawlers, or harvesting tools of any kind on the Platform;
Attempt to gain unauthorized access to any systems, accounts, servers, or data associated with the Platform;
Post false, misleading, defamatory, harmful, or fraudulent content about LucrTrade, its staff, or other community members;
Engage in or promote market manipulation, pump-and-dump schemes, coordinated trading signals for personal gain, or any activity designed to deceive other traders;
Promote or advertise financial products, investment schemes, external services, or competing platforms to other members;
Share or solicit other members’ personal information without their explicit consent;
Attempt to circumvent account restrictions, bans, or access controls;
Use the Platform in any manner that violates applicable laws, regulations, or regulatory guidance — including securities laws — in any jurisdiction.

Violations may result in immediate account termination without refund and, where applicable, civil or criminal legal action.

X. Intellectual Property

All content on the Platform — including but not limited to TradingView indicators, LucrJournal, educational materials, written content, market analysis, graphics, logos, trade names, and branding (collectively, “Content”) — is the exclusive intellectual property of LucrTrade Limited and is protected by copyright, trademark, and applicable intellectual property laws of Hong Kong and internationally.

LucrTrade grants you a limited, personal, non-transferable, non-sublicensable, and revocable license to access and use the Content solely for your personal, non-commercial trading and learning purposes, subject to this Agreement.

This license does not include any right to:

Reproduce, distribute, or publicly display the Content in any form;
Create derivative works based on the Content;
Use the Content for any commercial purpose;
Share indicators, tools, or course materials with non-members.

This license is automatically revoked upon any breach of this Agreement or termination of your membership. All rights not expressly granted herein are reserved by LucrTrade.

By posting any content in community channels (e.g., trade ideas, comments, analysis), you grant LucrTrade a non-exclusive, royalty-free, perpetual right to display, distribute, and use such content for Platform operations, educational materials, and promotional purposes.

XI. TradingView Indicators

Our indicators are published on the TradingView platform and are subject to TradingView’s Terms of Service in addition to this Agreement. Access to our indicators requires:

A valid and active TradingView account (governed by TradingView’s own terms);
An active LucrTrade Premium Membership.

LucrTrade does not guarantee continuous availability of indicators on TradingView, as TradingView is an independent third-party platform outside our control. We are not responsible for TradingView’s downtime, policy changes, technical issues, or any interruption to indicator access caused by TradingView.

Important: Our indicators are analytical tools only. They do not constitute financial advice or generate guaranteed trade signals. You bear sole responsibility for how you interpret and act on any indicator output.

XII. LucrJournal

LucrJournal is a local-first trading journal tool built on Obsidian. All journal data is stored locally on your own device. LucrTrade:

Does not have access to any of your LucrJournal data;
Does not store, back up, process, or transmit your journal entries or trading records;
Is not responsible for any data loss arising from device failure, software error, user error, or any other cause.

LucrJournal is provided as-is. Use is entirely at your own risk.

XIII. Discord Community

LucrTrade’s primary community operates on Discord. By joining our Discord server, you also agree to Discord’s Terms of Service and Community Guidelines (available at discord.com/terms). LucrTrade is not responsible for Discord’s platform availability, outages, or any policy changes made by Discord Inc.

Community moderators have full authority to remove content, warn, mute, kick, or permanently ban members who violate this Agreement or the community’s conduct standards, at LucrTrade’s sole discretion. All moderation decisions are final.

XIV. Third-Party Links, Services & Affiliate Disclosure

The Platform may contain links to third-party websites, platforms, tools, brokers, or services (including news sources, TradingView, and others). These links are provided for informational convenience only. LucrTrade does not endorse, control, verify, or accept any responsibility for third-party content, services, accuracy, or practices. Your use of any third-party services is at your own risk and governed entirely by their respective terms and policies.

Affiliate Links: The Platform may contain affiliate links. When you click on such links or make a purchase through them, LucrTrade may receive a commission or referral fee from the third party at no additional cost to you. The presence of an affiliate link does not constitute an endorsement or recommendation of the linked product, service, or platform. LucrTrade is not responsible for the content, accuracy, or practices of any third-party site accessed through an affiliate link.

XV. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

LUCRTRADE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF:

MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE;
ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT OR DATA;
UNINTERRUPTED, TIMELY, OR ERROR-FREE OPERATION OF THE PLATFORM;
PROFITABLE TRADING RESULTS FROM USE OF ANY TOOL, INDICATOR, OR CONTENT.

XVI. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LUCRTRADE LIMITED AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:

INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
TRADING LOSSES, INVESTMENT LOSSES, OR FINANCIAL LOSSES OF ANY KIND;
LOSS OF DATA, GOODWILL, OR BUSINESS OPPORTUNITY;

ARISING FROM OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE PLATFORM, REGARDLESS OF WHETHER LUCRTRADE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ALL CASES, LUCRTRADE’S MAXIMUM AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO LUCRTRADE IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR HKD 500, WHICHEVER IS LESS.

YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE PLATFORM IS TO STOP USING IT.

XVII. Indemnification

You agree to indemnify, defend, and hold harmless LucrTrade Limited and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

Your access to or use of the Platform;
Your violation of any provision of this Agreement;
Your trading activities, investment decisions, or financial outcomes;
Any content you post, share, or transmit on or through the Platform;
Your violation of any applicable law or third-party rights.

XVIII. Anti-Fraud Statement

LucrTrade Limited will NEVER:

Ask you to transfer funds, make payments, or send money to any individual team member or unofficial channel;
Request your passwords, API keys, seed phrases, private keys, or any sensitive account credentials;
Offer to manage your trading account, investment portfolio, or funds on your behalf.

Anyone claiming to represent LucrTrade while making any of the above requests is engaging in fraud. Do not comply under any circumstances. Report any such contact to us immediately through our official channels to verify authenticity.

XIX. Privacy

LucrTrade collects and processes personal information in accordance with our Privacy Policy. By using the Platform, you acknowledge and consent to such collection and use as described in the Privacy Policy. Please review our Privacy Policy carefully before using the Platform.

XX. Modifications to Terms & Platform

LucrTrade reserves the right to:

Modify, update, or discontinue any part of the Platform — including content, features, tools, and services — at any time and without prior notice;
Modify these Terms at any time, with changes taking effect immediately upon posting to the Platform;
Change membership fees or pricing, with reasonable advance notice for existing subscribers.

Your continued use of the Platform after any modification to these Terms constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

XXI. Termination

LucrTrade may suspend or permanently terminate your access to the Platform at any time, with or without cause, at its sole discretion. Upon termination:

Your access to all Platform features and content is revoked immediately;
No refund will be issued for any remaining subscription period;
Provisions of this Agreement that by their nature survive termination — including Sections III, IV, V, VIII, X, XV, XVI, XVII, and XXII — shall continue to apply.

You may cancel your membership at any time by contacting us at contact@lucrtrade.com or through your account dashboard. Cancellation takes effect at the end of your current billing period.

XXII. Governing Law & Dispute Resolution

This Agreement is governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising from or in connection with this Agreement or your use of the Platform shall first be submitted to good-faith negotiation between the parties. If the dispute cannot be resolved within 30 days of written notice, it shall be referred to and finally resolved by the courts of Hong Kong, to whose exclusive jurisdiction you hereby submit.

XXIII. Severability

If any provision of this Agreement is found by a court of competent jurisdiction to be unlawful, void, or unenforceable, that provision shall be deemed severable from the remainder of the Agreement and shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

XXIV. Entire Agreement

This Agreement, together with the Privacy Policy and Disclaimer, constitutes the entire agreement between you and LucrTrade regarding your use of the Platform and supersedes all prior and contemporaneous agreements, representations, and understandings, whether written or oral.

LucrTrade’s failure to enforce any provision of this Agreement does not constitute a waiver of its right to enforce that provision in the future.
